2. GENERAL INFORMATION
www.MicroSaltInc.com is a Site operated by MicroSalt Plc (MicroSalt). MicroSalt are a private limited company registered in England and Wales under company number 10061337 with the registered office at 12 New Fetter Lane, London, United Kingdom, EC4A 1JP.
3. SITE ACCESS
Access to the Site is permitted on a temporary basis, and MicroSalt reserves the right to withdraw or amend the service or products provided without notice to the user. MicroSalt will not be liable if for any reason the Site is unavailable at any time or for any period.
From time to time, MicroSalt may restrict access to some parts of the Site, or the entire Site.
The user is responsible for making all arrangements necessary to access the Site. In addition the user is responsible for ensuring that all persons who access the Site through their internet connection are aware of these terms and that they comply with them.
4. INTELLECTUAL PROPERTY RIGHTS
MicroSalt are the owner or the licensee of all intellectual property rights on the Site and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.
The user under no circumstances is permitted to modify the paper or digital copies of any materials and the user must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.
MicroSalt ’s status (and that of any identified contributors) as the authors of material on the Site must always be acknowledged.
The user must not use any part of the materials on the Site for commercial purposes without obtaining a licence to do so from MicroSalt or the relevant licensors.
Commentary and other materials posted on the Site are not intended to amount to advice on which reliance should be placed. MicroSalt therefore disclaim all liability and responsibility arising from any reliance placed on such materials by any visitor to the Site or by anyone who may be informed of any of its contents.
6. WARRANTY PROVISIONS
6.1 The material displayed on the Site is provided without any guarantees, conditions or warranties as to its accuracy. To the extent permitted by law, MicroSalt , other members or group companies and third parties connected to the firm hereby expressly exclude:
6.1.1 All conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity.
6.1.2 Any liability for any direct, indirect or consequential loss or damage incurred by any user in connection with the Site or in connection with the use, inability to use, or results of the use of the Site, any websites linked to it and any materials posted on it, including, without limitation any liability for:
(a) loss of income or revenue;
(b) loss of business;
(c) loss of profits or contracts;
(d) loss of anticipated savings;
(e) loss of data;
(f) loss of goodwill;
(g) wasted management or office time; and
(h) for any other loss or damage of any kind, however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable, provided that this condition shall not prevent claims for loss of or damage to the users tangible property or any other claims for direct financial loss that are not excluded by any of the categories set out above.
6.2 This does not affect MicroSalt ’s liability for death or personal injury arising from negligence of the firm nor liability of the firm for fraudulent misrepresentation or misrepresentation as to a fundamental matter nor any other liability which cannot be excluded or limited under applicable law.
6.3 MicroSalt makes no warranty, express or implied, in respect to content or material and is under no obligation to update such material.
6.4 MicroSalt shall have no liability, contingent or otherwise, to the user or to third parties, or any responsibility whatsoever, for the failure of any connection or communication service to provide or maintain the users access to this service or for any interruption or disruption of such access or any erroneous communication between MicroSalt and the user, regardless of whether the connection or communication service is provided by MicroSalt or a third party service provider. MicroSalt shall have no liability, contingent or otherwise, to the user or to third parties, for the correctness, quality, accuracy, timeliness, reliability, performance, continued availability, completeness or delays, omissions, or interruptions in the delivery of the data and services available on the Site or for any other aspect of the performance of this service or for any failure or delay in the execution of any transactions through this service. In no event will MicroSalt be liable for any special, indirect, incidental, or consequential damages which may be incurred or experienced on account of the user using the data or services made available on the Site, even if MicroSalt has been advised of the possibility of such damages. MicroSalt will have no responsibility to inform the user of any difficulties experienced by MicroSalt or third parties with respect to the use of the services or to take any action in connection therewith.
6.5 MicroSalt makes no warranty whatsoever to the user, express or implied, regarding the security of the site, including with respect to the ability of unauthorized persons to intercept or access information transmitted by the user through this service.
7. CAPACITY LIMITATIONS
As a result of high Internet traffic, transmission problems, systems capacity limitations, and other problems, the user may, at times, experience difficulty accessing the Site or communicating with MicroSalt through the internet or other electronic and wireless services. Any computer system or other electronic device, whether, it is the users, an internet service provider’s or MicroSalt ‘s can experience unanticipated outages or slowdowns or have capacity limitations.
8. SITE TRANSACTIONS
Contracts for the supply of services formed through the Site or as a result of visits made by the user are governed by the firm’s terms and conditions of supply.
9. UPLOADING MATERIAL TO THE SITE
Whenever the user makes use of a feature that allows the user to upload material to the Site or to make contact with other users of the Site the user must comply with the content standards set out in the acceptable use policy. The user warrants that any such contribution does comply with those standards and the user indemnifies MicroSalt for any breach of that warranty.
Any material the user uploads to the Site will be considered non-confidential and non-proprietary and MicroSalt has the right to use, copy, distribute and disclose to third parties any such material for any purpose. MicroSalt also has the right to disclose the users identity to any third party who is claiming that any material posted or uploaded by the user to the Site constitutes a violation of their intellectual property rights or of their right to privacy.
MicroSalt will not be responsible or liable to any third party for the content or accuracy of any materials posted by the user.
MicroSalt has the right to remove any material or posting the user makes on the Site if, in the opinion of the firm such material does not comply with the content standards set out in the acceptable use policy.
10. VIRUSES, HACKING AND OTHER OFFENCES
The user must not misuse the Site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. The user must not attempt to gain unauthorised access to the Site, the server on which the Site is stored or any server, computer or database connected to the Site. The user must not attack the Site via a denial-of-service attack or a distributed denial-of service attack.
By breaching this provision, the user would commit a criminal offence under the Computer Misuse Act 1990. MicroSalt will report any such breach to the relevant law enforcement authorities and MicroSalt will co-operate with those authorities by disclosing the users identity to them. In the event of such a breach the users right to use the Site will cease immediately.
MicroSalt will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect computer equipment, computer programs, data or other proprietary material due to the users use of the Site or to as a result of a download of any material posted on it or on any website linked to it.
The user may link to the home page, provided the user does so in a way that is fair and legal and does not damage or take advantage of MicroSalt ’s reputation but the user must not establish a link in such a way as to suggest any form of association, approval or endorsement on MicroSalt ’s part where none exists.
The user must not establish a link from any website that is not owned by the user.
The Site must not be framed on any other site nor may the user create a link to any part of the Site other than the home page. MicroSalt reserves the right to withdraw linking permission without notice. The website from which the users are linking must comply in all respects with the content standards set out in the acceptable use policy.

12. USER INFORMATION AND SITE MONITORING
In general the use of the products and services on the Site may be monitored by MicroSalt and the resultant information may be used by MicroSalt for its internal business purposes or in accordance with the rules of any applicable regulatory or self-regulatory organisation.
13. LINKS FROM THE SITE
This service may provide links to certain internet sites sponsored and maintained by third parties. MicroSalt is providing such links solely as a convenience to the user. As a result MicroSalt makes no representations concerning the content of the sites. The fact that MicroSalt has provided a link to the site does not constitute an endorsement, authorisation, sponsorship, or affiliation by MicroSalt with respect to the site, its owners, or its providers. MicroSalt has not tested any information, software or products found on any of the sites and therefore does not make any representations with respect thereto, including any representations regarding the content or sponsors of the site or the suitability or appropriateness of the products or transactions described therein.
14. PARTIAL INVALIDITY
If, at any time, any provision of these terms is or becomes illegal, invalid or unenforceable in any respect under any law of any jurisdiction, neither the legality, validity or enforceability of the remaining provisions nor the legality, validity or enforceability of such provision under the law of any other jurisdiction will in any way be affected or impaired.
15. JURISDICTION AND APPLICABLE LAW
The English courts will have exclusive jurisdiction over any claim arising from, or related to, a visit to the Site although MicroSalt retains the right to bring proceedings against the user for breach of these conditions in the user’s country of residence or any other relevant country.
